At Proctor & Popia, LLC, located in Beaverton, Oregon, our criminal defense practice focuses on defending misdemeanor offenses such as:

  • DUIIs
  • Simple theft and shoplifting
  • Assault
  • Criminal mischief
  • Domestic violence, including elder abuse

We also handle some felony charges. If you have been arrested or charged with a crime, call before your arraignment whenever possible. Do not procrastinate - contact us today for an immediate and confidential consultation.

Our attorneys place a special emphasis on using our negotiation skills and legal knowledge to find alternatives to jail time for our criminal defense clients. In some cases, you may be eligible for a diversion program. With a diversion program, the defendant pleads guilty, or no contest, to the charge. In some cases, the defendant may also be required to pay financial restitution to a victim and/or perform community service. Sometimes, the defendant is required to attend an evaluation and then an educational or treatment program, such as alcohol or drug rehab, or an anger management program. If the defendant successfully completes all the requirements of the diversion program, then the charges may be dismissed. In some cases, it is also possible to move to have the arrest expunged from your record.

Driving Under The Influence Of Intoxicants (DUII) Charges

In Oregon, the legal limit for blood alcohol level (BAC) while driving a vehicle is .08. However, in Oregon you may also be arrested and even convicted of DUII if your BAC shows a result of less than .08. That is because the law states that a person commits the offense of driving while under the influence of intoxicants if the person drives a vehicle while the person has a BAC of 0.08 or more or is under the influence of intoxicating liquor, a controlled substance or an inhalant; or a combination of intoxicating substances.

You may also be surprised to learn you can be convicted of DUII if your driving is adversely affected by prescription medication.

Finally, although drivers with CDL's were once ineligible for diversion, recent changes may allow some drivers with a CDL that is no longer valid, to participate in diversion.

Proctor & Popia, LLC understands the challenges defendants face when arrested with a BAC of less than .08. We encourage you to call us immediately if you are charged. We want to get to work on your defense immediately, so that we can build as strong a case as possible. The penalties for a DUII conviction in Oregon can be harsh, even on a first offense and even if your BAC is under the legal limit. The maximum penalties include:

  • A year in jail
  • A $6,250 fine
  • Additional expenses associated with attending an alcohol treatment program
  • Suspension or revocation of your drivers' license
