Medicaid Planning

Medicare is a health insurance program providing payment for medical needs for all senior citizens 65 and over and for individuals with a certain level of disability. Medicare provides only limited coverage of prescription medications and long-term care in a nursing home or an adult care facility.

Medicaid is a federal program that provides payment for physicians' services, hospital care, medications, supplies and other necessary services for people who are unable to afford it. It also pays for the expenses of long-term care.

Medicaid pays for all medical needs for those of any age who have been determined to be eligible. A person with limited income and resources who has Medicare coverage may also qualify for Medicaid benefits.

Through financial planning and assistance from an elder law attorney that understands the Medicaid program, it is possible for you to qualify for Medicaid benefits that will cover your potential stay in a nursing home or care center.

Special Needs Trusts

Those who wish to use their estate plan to care for aging family members or loved ones with disabilities should consult with an attorney before proceeding.

Keep in mind that since many government benefits, including Medicaid and some Social Security Programs, are only available for those with limited resources. Your financial gift could impact your loved ones' eligibility for assistance while not providing enough support to supplant their need for benefits.

Guardianships and Conservatorships

When people are affected by Alzheimer's disease, dementia, or other debilitating illness, they may become unable to responsibly see to their financial business and personal welfare. In these cases and in other situations, such as those involving minor children, a guardianship or conservatorship may be needed.
